End User License Agreement (EULA) — Clever Invoice App
1. Scope
These Terms of Use (End User License Agreement / EULA) apply to the use of the mobile application "Clever Invoice" (hereinafter "App"), provided by dieBestenderStadt Media GmbH, Kleiner Sand 2, 76829 Landau, Germany (hereinafter "Provider").
By using the App, you agree to these Terms. For the use of our website, please refer to our general terms and conditions.
2. Description of Services
Clever Invoice is an invoicing and quoting application for businesses, freelancers, and self-employed professionals. The App enables:
- Creation and management of invoices and quotes
- AI-powered invoice creation via chat and voice
- Customer management and product catalog
- PDF creation and email delivery
- E-invoicing in XRechnung and ZUGFeRD format
- VAT-compliant invoicing
3. User Account
A user account is required to use the App. You are responsible for keeping your login credentials confidential and for all activities under your account.
You can delete your account at any time in the App settings. After deletion, your data will be removed within 30 days, unless statutory retention obligations apply.
4. Subscriptions and Payment Terms
4.1 Free Use
The App can be used with limited functionality for free (Starter plan: up to 5 invoices and 5 quotes per month, 10 customers, 20 products).
4.2 Paid Subscriptions
Premium features are available through paid subscriptions:
- Professional (Pro) — Unlimited invoices and quotes, customer management, recurring invoices, payment reminders, DATEV export, premium templates. Available as weekly or annual subscription.
- Business — All Professional features plus multiple business profiles, WhatsApp integration, API access, and priority support. Available as weekly or annual subscription.
All subscriptions are processed as in-app purchases through the Apple App Store.
4.3 App Store Subscription Terms
Payment will be charged to your App Store account at confirmation of purchase. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscriptions can be managed and canceled in your App Store Settings under "Subscriptions".
4.4 Prices
All prices are in Euro (EUR) including applicable VAT. Current prices are displayed in the App Store and are subject to change.
5. Conclusion of Contract
The contract for using the App is concluded when you create a user account. The contract for a paid subscription is concluded upon confirmation of the in-app purchase in the App Store.
6. Right of Withdrawal
The right of withdrawal for digital content expires upon commencement of contract execution, provided you have given your express consent. You may cancel your subscription at any time, effective at the end of the current billing period, through the App Store Settings.
7. Usage Rights
The Provider grants you a simple, non-transferable right to use the App within the scope of these Terms. You may not copy, modify, decompile, or use the App for unlawful purposes.
Content you create (invoices, quotes, customer data) remains your property. You can export it at any time.
8. Intellectual Property
All rights to the App, including design, code, trademarks, and content, belong to the Provider. Use of the App does not grant ownership of any intellectual property of the Provider.
9. Data Protection
The processing of your personal data is carried out in accordance with the General Data Protection Regulation (GDPR). For details, please refer to our App Privacy Policy.
10. Availability
The Provider strives for uninterrupted availability of the App. There is no entitlement to permanent availability. Maintenance, updates, and technical disruptions may lead to temporary restrictions.
11. Liability
The Provider is only liable for damages caused by intent or gross negligence. Liability for slight negligence is limited to the breach of essential contractual obligations (cardinal obligations).
The App serves as a tool for invoice creation. The Provider assumes no liability for the tax or legal correctness of the documents created. For tax questions, please consult a qualified tax advisor.
12. Changes to the Terms
The Provider reserves the right to change these Terms at any time. Material changes will be communicated at least 30 days before taking effect via email or in-app notification. Continued use of the App after the changes take effect constitutes acceptance.
13. Governing Law and Jurisdiction
The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Landau in der Pfalz, Germany, to the extent permitted by law.

15. Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.
